Safety at the Viridian: I am hoping to get a few “safety” codes to be enforced,and monitored by the Metro Health Department (Pools), and Metro Building Codes to insure surroundings that are “safe” for the roof top pool deck at the Viridian. This snapshot was taken by a drone camera of the roof top pool deck at the Viridian in downtown Nashville, TN. Please notice, as you look at this snapshot, the 14’ perimeter wall section that is totally open with no safety barrier for a 225' drop-off or 350’ drop-off and the two inside 14' walls that form the stairs with a 10' drop-off. An object in free fall for 350' would be traveling at 85 - 95 mph on impact! Metro Codes follows these International building codes: International Building Code 2000; Code 1003.2.12 Guards: "Guards shall be located along open-sided walking surfaces, mezzanines, industrial equipment platforms, stairways, ramps and landings which are located more than 30 inches above the floor or grade below." And Code 1003.2.12.1 Height: "Guards shall form a protective barrier not less than 42 inches high, measured vertically above the leading edge of the tread, adjacent walking surface or adjacent seatboard." If this were an active construction site, is there any doubt there would be adequate and securely fastened safety barriers for these three 14’ walls that are now totally open? Should Metro Codes and Metro Health have permitted this roof top pool without proper safety codes? Can you guess the interest of Metro Health (pools) and Metro Building Codes, regarding this safety concern for the Viridian condos? This site has an EXIT sign directing people to steps going down for an emergency exit, and/or to steps, plus a walking surface, accessible to nearly any 4 year old, leading up to the 5 open sided walking surfaces with no fencing! Did the contractor complete this site, or simply abandon the idea of a kite surfing platform? In the Spring of 2019, one of the department heads of Metro Building codes was in a circuit court hearing regarding these safety concerns, with Judge Escobar presiding, and was quizzed about these unguarded walking surfaces. When quizzed about the lack of fencing or guardrails on these 5 open sided walking surfaces at the Southern Border, his response was "I don't teach human behavior!" He made an identical response to me in his office, a week or two later, when I specifically pointed out to him the lack of fencing on these 5 open sided walking surfaces with DEADLY drop-offs! Is the Metro Building Code's response a profound, inept, inadequate, unbelievable, and TOTALLY unsatisfactory response? In like manner, a representative from Metro Pools said that the fences around pools are only designed and installed to keep children, and others, out of the pool area. WOW! Should Metro have permitted this pool, and pool deck, deck with these SAFETY concerns? Although I was not elected to the Viridian Board in May of 2021, I intend to advance this safety concern by promoting the agenda of getting adequate guardrails and fencing installed at the Southern Border of the rooftop pool deck!
